These Terms & Conditions (the “Terms”) govern your booking with Our Tribe Limited (“we”, “us”, “Supplier”, “The Tribe Boats”), company number 12953885, registered at Suite 3, Shrieves Walk, Stratford Upon Avon, Warwickshire CV37 6GJ. These Terms apply to all bookings made via the website www.thetribe.boats (“Website”), any booking platform we use, and any charter services, experiences, goods or ancillary services you purchase from us (“Services”) (The Tribe Travel Company).
Please read these Terms carefully before booking. By making a booking with us, you agree to be bound by these Terms.
1.1 Customer: The person making the booking with us (“you”).
1.2 Booking Confirmation: The email confirming your booking and details of your charter.
1.3 Services: Any boat charter, excursion, additional service or product provided by us.
1.4 Deposit: The amount payable at the time of booking to secure your charter.
1.5 Balance: Remaining monies due after the deposit payment.
Other definitions and interpretation clauses remain as set out in the existing generic wording on the website and continue to apply unless varied below (The Tribe Travel Company).
2.1 Your booking constitutes an offer to purchase Services in accordance with these Terms.
2.2 A booking is only accepted when we send a Booking Confirmation email and the deposit has been received.
2.3 These Terms apply to the exclusion of any other terms proposed by you (except as expressly agreed in writing by us) (The Tribe Travel Company).
3.1 The deposit is payable on booking and is required to secure your charter.
3.2 The price of the Services will be as quoted on the Website, subject to any applicable taxes, fees or currency conversion charges (The Tribe Travel Company).
3.3 The balance of the total price is due by the date specified in your Booking Confirmation.
3.4 Failure to pay the balance by the due date may result in cancellation and cancellation fees at our discretion.
3.5 All payments are processed in accordance with clause 4 of the generic Terms & Conditions and by our third-party payment processors (The Tribe Travel Company).
4.1 Cancellation by You (the Customer):
(a) If you cancel more than 35 days before departure, your deposit will be fully refunded.
(b) If you cancel within 35 days of departure, your deposit is non-refundable.
4.2 If you wish to change your booking date, time or services, please contact us as soon as possible. Changes are subject to availability and may be treated as a cancellation in line with clause 4.1 above.
4.3 Refunds are made less any platform, transaction and processing fees that have been incurred (The Tribe Travel Company).
5.1 Safety is our priority. If weather conditions are deemed unsafe by the captain, we will:
(a) Always try to reschedule your charter to an alternative time or date that works for you.
(b) If rescheduling is not possible, we will issue a full refund of your deposit.
5.2 Decisions relating to weather and safety are made solely by the captain and crew and are final.
6.1 Prior to departure, you will receive The Tribe Safety at Sea video 24 hours before your charter.

6.2 A mandatory safety briefing will be delivered by the captain before leaving the marina.
6.3 Boat surfaces can be slippery when wet — please take care when moving around.
6.4 As the boat exits the marina, it may suddenly pick up speed; remain seated until you reach your first stop.
6.5 Please wear sunscreen and drink plenty of water — the sun is strong at sea.
6.6 You must follow all safety instructions given by the captain and crew at all times.
6.7 Failure to follow safety instructions may result in the charter being modified or terminated without refund.
Final Safety Notice
Participation in all onboard activities is entirely at your own risk. Guests must follow all safety instructions given by the captain and crew. The captain’s decisions relating to safety, weather and sea conditions are final.
We operate out of a private marina. To ensure smooth boarding and respect for our neighbours:
7.1 T-shirts must be worn when walking through the marina and boarding/disembarking.
7.2 No large glass bottles of spirits are permitted in the marina or onboard.
7.3 Please be respectful and keep noise to a reasonable level when moving to and from the boats.
7.4 Abuse or aggression towards our team, captains or marina staff will not be tolerated and may result in removal from the marina and/or charter without refund.
8.1 Sensible alcohol consumption is expected.
8.2 Illegal substances are strictly prohibited.
8.3 The captain has authority to refuse boarding or end the charter if safety is compromised.
9.1 Nothing in these Terms will exclude or limit our liability for death or personal injury resulting from our negligence or fraud.
9.2 You are encouraged to take out adequate travel insurance covering your participation in the Services, including but not limited to personal injury, cancellation, damage or loss of belongings.
9.3 We accept no liability for loss, theft or damage to personal belongings.
9.4 Our liability to you in all other cases is limited to the total amount you paid to us for the Services, except where prohibited by law (The Tribe Travel Company).
We will not be liable if prevented from performing obligations due to circumstances beyond our reasonable control, including unforeseeable weather, strikes, government action, civil unrest, or other events listed under clause 11 of the generic Terms & Conditions (The Tribe Travel Company).
Any complaint must be raised in writing within 30 days after the end of your charter to the email address provided in your Booking Confirmation.
12.1 These Terms & Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
12.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
12.3 Notwithstanding clauses 12.1 and 12.2, all charters, vessel operations, safety procedures and maritime conduct are carried out in accordance with Spanish and Balearic Islands maritime laws and regulations, which apply while onboard and within Spanish territorial waters.
12.4 In the event of any conflict between these Terms and applicable Spanish maritime or safety regulations, the relevant maritime and safety regulations shall take precedence in respect of onboard conduct and vessel operation.
We may update these Terms from time to time. The version that applies will be the one published on the Website at the time of your booking. You are advised to review them each time you book.
